The latest issue of Private Eye<\/em> carries the following two short articles under the headline Phony <\/em>forensics<\/em>.<\/p>\n

The <\/em>last Eye’s revelations <\/em>that <\/em>the <\/em>crown <\/em>I <\/em>had kept <\/em>secret <\/em>a <\/em>report which undermined prosecution claims about <\/em>the <\/em>circuit <\/em>board fragment <\/em>used <\/em>to <\/em>convict Abdelbasset <\/em>al-Megrahi <\/em>of <\/em>the <\/em>1988 <\/em>Lockerbie bombing <\/em>has <\/em>prompted justice campaigner <\/em>Jim <\/em>Swire to <\/em>raise <\/em>further <\/em>questions. <\/em>\u00a0<\/em>The fragment, <\/em>said <\/em>to <\/em>be <\/em>part <\/em>of <\/em>the <\/em>bomb’s timing <\/em>device, was <\/em>said <\/em>to <\/em>have <\/em>been found by scientists embedded <\/em>in <\/em>blasted shirt remains, <\/em>and <\/em>the <\/em>evidence bag <\/em>in which it <\/em>was discovered <\/em>had been <\/em>altered <\/em>by <\/em>someone <\/em>who <\/em>was never <\/em>identified.<\/em><\/p>\n

Furthermore, the fragment <\/em>had tested <\/em>\u201cnegative\u201d f<\/em>or <\/em>explosive <\/em>traces <\/em>and there were discrepancies about <\/em>how <\/em>it <\/em>was <\/em>stored, tested <\/em>and identified. <\/em>It <\/em>had been passed <\/em>between <\/em>UK <\/em>scientists <\/em>and <\/em>the <\/em>US <\/em>investigators <\/em>who<\/em> came up <\/em>with <\/em>the \u201c<\/em>match\u201d to <\/em>timing <\/em>devices <\/em>supplied <\/em>to <\/em>Libya <\/em>thus <\/em>linking <\/em>the <\/em>country <\/em>and <\/em>Megrahi <\/em>to the bombing, <\/em>which <\/em>killed <\/em>270 people, <\/em>including Dr Swire’s <\/em>daughter, Flora.<\/em><\/p>\n

“Now <\/em>that we <\/em>know that it <\/em>was always <\/em>known <\/em>that it <\/em>could <\/em>not have <\/em>been <\/em>part of a Libyan <\/em>timer <\/em>used <\/em>in <\/em>the bomb, where <\/em>did it <\/em>come <\/em>from?\u201d asked Swire. <\/em>So <\/em>far there <\/em>is <\/em>no <\/em>indication <\/em>that the <\/em>Crown <\/em>Office <\/em>has <\/em>chosen <\/em>find <\/em>out.<\/em><\/p>\n

No<\/em>r, says <\/em>Dr <\/em>Swire, <\/em>is <\/em>it <\/em>looking into <\/em>the <\/em>break-in <\/em>at <\/em>Heathrow <\/em>16 <\/em>hours before the departure <\/em>of PanAm <\/em>flight <\/em>103. <\/em>This information was <\/em>also w<\/em>ithheld from Megrahi’s <\/em>trial <\/em>\u2013 although it <\/em>had <\/em>been <\/em>disclosed by the time <\/em>of <\/em>his appeal. <\/em>A<\/em>s <\/em>he <\/em>told <\/em>the <\/em>Eye: <\/em>“I <\/em>would like to know why <\/em>this <\/em>myth <\/em>about the fragment and <\/em>Libyan bombs f<\/em>rom Malta <\/em>is <\/em>still <\/em>being <\/em>used <\/em>to <\/em>conceal the truth, and why the <\/em>real <\/em>perpetrators remain free from ever being brought before any <\/em>court for <\/em>this crime against <\/em>humanity.”<\/em><\/p>\n

Earlier <\/em>this year the Scottish newspaper the <\/em>Herald confidently <\/em>reported that <\/em>two <\/em>oft he <\/em>leading lawyers <\/em>involved in <\/em>the <\/em>Lockerbie <\/em>case <\/em>were <\/em>about <\/em>to become <\/em>high court judges. <\/em>It <\/em>said that <\/em>the judicial <\/em>appointments board <\/em>had <\/em>recommended <\/em>for <\/em>the bench <\/em>the former Lord <\/em>Advocate <\/em>Colin (now Lord) Boyd <\/em>QC, <\/em>who <\/em>led the<\/em><\/p>\n

prosecution <\/em>of <\/em>Megrahi, <\/em>and <\/em>Maggie <\/em>Scott <\/em>QC, who led<\/em> <\/em>Megrahi’s <\/em>abandoned appeal, along <\/em>with Michael <\/em>Jones <\/em>and <\/em>David <\/em>Burns. <\/em>[JA note: in fact David Burns QC was also involved in the case, as he was the second senior counsel on Abdelbaset\u2019s team.]<\/p>\n

Lord Boyd was recently criticised by <\/em>the <\/em>Scottish <\/em>Criminal <\/em>Cases <\/em>Review <\/em>Commission <\/em>for <\/em>failing <\/em>to disclose crucial <\/em>information <\/em>about <\/em>a series <\/em>of CIA <\/em>cables <\/em>referring <\/em>to <\/em>its Walter <\/em>Mitty-like <\/em>“star witness”, <\/em>Abdul Majid <\/em>Giaka, <\/em>a <\/em>so-called double <\/em>agent, w<\/em>hich completely undermined <\/em>the <\/em>witness\u2019s credibility <\/em>(Eyes <\/em>passim). But <\/em>guess <\/em>who <\/em>failed to <\/em>make <\/em>the judicial <\/em>cut out <\/em>of the four <\/em>candidates? <\/em>Only <\/em>the <\/em>troublesome <\/em>Ms <\/em>Scott. <\/em>She <\/em>declined to <\/em>discuss <\/em>the matter <\/em>with <\/em>the <\/em>Eye.<\/em><\/em><\/p>\n
